Utah Gov. Gary Herbert is calling for nearly every major gun control measure there is.
Speaking at his monthly KUED news conference, the governor specifically mentioned proposals such as expanded background checks and age limits. He also brought up extreme risk protection orders, or “red flag” laws, which allow law enforcement to temporarily confiscate the weapons of someone deemed a danger to themselves or others.
The governor said violence in video games and movies should bear some of the blame for mass shootings.
“I think all those things ought to be talked about and discussed in an open and frank manner and see if we can’t change the culture in which we seem to find ourselves in today where violence is just an acceptable part of life. I think there is a sense of frustration about why is it happening and what can we do to prevent it.”
Utah saw a bill to bring red flag laws introduced last year, as well as a bill to expand background checks, but neither bill became law, GunPowder Magazine reports.
Rep. Stephen Handy, R-Layton, “has said he plans to reintroduce the red flag bill in 2020 for the third year in a row.”
Red flag laws allow a judge to order a person’s firearms be confiscated if they are deemed a threat to themselves or others. State Rep. Steve Handy (R-Layton) proposed such a bill in Utah during the 2019 legislative session but it faced resistance from his fellow Republican lawmakers.
“I’ve been just thrashed by Second Amendment folks that it’s a gun grab,” Handy said, “It’s not a gun grab. It’s decided by a judge, temporarily. With the frequent occurrence of these things, it’s just horrific and you never know what’s going to happen. Why not have something reasonable like this?”
ERPOs open up a Pandora’s Box of ways for cunning lawyers and conniving family members to exploit gun owners.
Red flag ERPO bills have been written so broadly on two fronts that in some instances, people are given near-endless possibilities by which to use the legal system to persecute gun owners.
Some ERPO bills restrict those who can report “high risk” individuals to family and law-enforcement, whereas some laws would expand the list to allow just about anybody to accuse anyone for anything.
