Trump strikes back, sues House Democrats, New York state officials, to shield his tax returns
Tax returns are a private matter and that is especially true for the president of the United States who is being victimized by the opposition party as it tries to score political points with its voting base, POTUS will argue in a lawsuit filed in federal court in Washington, D.C., on Tuesday.
The president is suing the House Committee on Ways and Means and New York state, claiming congressional Democrats were working with New York Democrats to get around federal laws that protect his tax returns, according to The Hill.
The lawsuit claims that Rep. Richard Neal (D-Mass.), chairman of the Ways and Means Committee, is trying to use a new law passed in May by New York Democrats that authorizes the release of the president’s state tax records to congressional committees.
Trump was, of course, a resident of New York before he became president.
Known as the TRUST Act, the law also applies to presidential staff and Cabinet members who hail from New York as well as New York state elected officials and judges.
New York’s Democratic majority has been harassing the president since his election, and the law, the suit argues, clearly targets one man — President Donald Trump.
“New York legislators admitted that the TRUST Act’s purpose was to help the Committee expose the President’s private tax information for political gain; its purpose was their purpose,” the lawsuit states.
“And New York Democrats designed the TRUST Act to be a complement to the Committee’s litigation over the President’s federal tax returns — a ‘workaround,’ an ‘in case of emergency break glass’ option, a ‘constitutional escape hatch should [the Committee] not want to wait for the federal court case and its appeals process to be finalized.”
The House Ways and Means Committee filed a lawsuit of its own in federal court against the Trump administration July 2 after Treasury Secretary Steve Mnuchin refused to comply with a congressional request to hand over years’ worth of the president’s tax returns.
In his letter refusing the request, Mnuchin called the committee’s demand an “abuse of power.”
Mnuchin noted in his letter that what the committee is attempting to do could prove harmful to the privacy of every American taxpayer.
“The legal implications of this request could affect protections for all American against politically-motivated disclosures of personal tax information, regardless of which party is in power,” Mnuchin wrote.
Democrats have been demanding to see POTUS’ tax returns since before he was elected in 2016, something Trump’s lawsuit notes. Having failed, the suit adds, Democrats are now turning to other methods.
“Ultimately, this issue was litigated in the 2016 election. Voters heard the criticisms from [former] Secretary [of State Hillary] Clinton, and they elected President Trump anyway. Democrats in Congress and across the country, however, have only become more eager to disclose the President’s tax returns for political gain,” the lawsuit states.
Legal and constitutional scholars supportive of the president have argued that the Constitution says nothing about a president having to reveal his financial or tax information in order to run for the office.
As such, they say that state laws seeking to add the requirement likely would not withstand federal or Supreme Court challenges.
